Composite Fencing

J. Sonic Services warrants to the original residential purchaser (“Purchaser”, “you” or “your”) that, for a period of twenty-five (25) years from the date of original purchase, under normal residential use and service conditions, composite fencing shall be free from material defects in workmanship and materials, and shall not split, splinter, rot, or suffer structural damage resulting from termites or fungal decay. For purposes of this warranty, a “residential purchaser” refers to an individual residential homeowner

If a defect occurs within the warranty period, Purchaser shall notify J. Sonic Services in writing and, upon confirmation by an authorized J. Sonic Services representative of the defect, J. Sonic Services sole responsibility shall be, at its option, to either replace the defective item or refund the portion of the purchase price paid by purchaser for such defective item (not including the cost of its initial installation). TO THE FULLEST EXTENT PERMITTED UNDER THE LAW, THIS WARRANTY SHALL NOT COVER AND J. SONIC SERVICES SHALL NOT BE RESPONSIBLE FOR COSTS AND EXPENSES INCURRED WITH RESPECT TO THE REMOVAL OF DEFECTIVE J. SONIC SERVICES PRODUCTS OR THE INSTALLATION OF REPLACEMENT MATERIALS, INCLUDING BUT NOT LIMITED TO LABOR AND FREIGHT.

For questions regarding the warranty, the original residential purchaser must contact our Customer Service Department at 1-833-540-2118 or via e-mail at info@jsonic.ca. ORIGINAL PROOF OF PURCHASE MUST ACCOMPANY ALL WARRANTY CLAIMS. The original residential purchaser will be notified by J. Sonic Services as to whether the warranty claim is approved or denied.

Replacement material will be provided that is as close as possible in color, design, and quality as the replaced material, but J. Sonic Services does not guarantee an exact match as colors and design may change. If a valid warranty claim hereunder is made during years eleven (11) through twenty-five (25) after the original purchase, recovery will be prorated. If J. Sonic Services is providing replacement materials, it may elect to replace the percentage listed below of boards otherwise meeting the requirements for a claim, or if it is refunding the purchase price, it may elect to refund the percentage listed below of the purchase price of boards otherwise meeting the requirements for a claim.

J. Sonic Services does not warrant against and is not responsible for any condition attributable to: (1) improper installation of the products and/ or failure to abide by installation guidelines, including but not limited to improper gapping; (2) use of the products beyond normal and proper use, or in an application not recommended by J. Sonic Services guidelines and local building codes; (3) movement, distortion, collapse or settling of the ground or the supporting structure on which the products are installed; (4) any act of God (such as flooding, hurricane, earthquake, lightning, etc.), environmental condition (such as air pollution, mold, mildew, etc.), staining from foreign substances (such as dirt, grease, oil, etc.), or normal weathering (exposure to sunlight, weather and atmosphere which will cause any colored surface to gradually fade, chalk, or accumulate dirt or stains); (5) improper handling, storage, abuse or neglect by purchaser, the transferee or third parties; or (6) ordinary wear and tear.

Conditions and Exclusions of This Warranty

THIS WARRANTY MUST BE REGISTERED WITHIN 30 DAYS OF INSTALLATION WITH J. SONIC SERVICES. THIS WARRANTY APPLIES ONLY TO THE ORIGINAL PURCHASER AND IS NON-TRANSFERABLE. THE AMOUNT OF YOUR RESTITUTION WILL NOT INCLUDE LABOR TO REMOVE EXISTING COMPONENTS OR INSTALL THE REPLACEMENT COMPONENTS, SHIPPING CHARGES, SALES TAX OR ANY OTHER CHARGES, NOR IS J. SONIC SERVICES REQUIRED TO PROVIDE SUCH LABOR OR SERVICE. THE MANUFACTURER RETAINS THE RIGHT TO DESIGNATE A REPRESENTATIVE TO INSPECT THE FENCE AND REMOVE SAMPLES FOR ANALYSIS. REMOVING THE FENCE PRIOR TO INSPECTION VOIDS THE WARRANTY. THIS LIMITED WARRANTY IS IN LIEU OF ALL OTHER EXPRESS WARRANTIES. J. SONIC SERVICES MAKES NO OTHER EXPRESS WARRANTIES AND DOES NOT AUTHORIZE ANY OTHER PERSON OR AGENT TO MAKE ANY OTHER EXPRESS WARRANTIES. J. SONIC SERVICES NEITHER ASSUMES NOR AUTHORIZES ANY OTHER LIABILITY OR OBLIGATION IN WARRANTY, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THIS PRODUCT, IS LIMITED IN DURATION TO THE TWENTY-FIVE (25) YEAR TERM OF THIS LIMITED WARRANTY. IN NO EVENT SHALL J. SONIC SERVICES BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, OR INCIDENTAL DAMAGES ARISING OUT OF OR CONNECTED WITH THE PURCHASE OR USE OF THIS PRODUCT OR FOR ANY BREACH OF WARRANTY.

MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE. THIS WARRANTY IS APPLICABLE ONLY TO COMPOSITE FENCES INSTALLED WITHIN THE CONTINENTAL UNITED STATES AND CANADA.

Glass Fencing

J Sonic Services Frameless Glass Fences are covered by a 20 year warranty for residential use. The stipulations of the warranty are as follows:

• The Product will be free from defects in material and workmanship in the course of manufacturing;

• The Product will not chip, peel, flake or blister under ordinary use or wear.

The following conditions apply to the warranty and may void the warranty if not followed correctly:

• The fence must be installed according to the installation instructions provided;

• If filing a warranty, it must be submitted within 30 days of the discovery of the damage;

• Proof of purchase, such a bill of sale, is mandatory when requesting warranty service;

• The manufacturer reserves the right to designate a representative to inspect the floor in question and remove samples for analysis;

• Removing the installation prior to contacting the claims department will void the warranty.

TO THE FULLEST EXTENT PERMITTED UNDER THE LAW, THIS WARRANTY SHALL NOT COVER AND J SONIC SERVICES SHALL NOT BE RESPONSIBLE FOR COSTS AND EXPENSES INCURRED WITH RESPECT TO THE REMOVAL OF DEFECTIVE J SONIC SERVICES PRODUCTS OR THE INSTALLATION OF REPLACEMENT MATERIALS, INCLUDING BUT NOT LIMITED TO LABOR AND FREIGHT

The original residential purchaser must contact J Sonic Services customer service directly via phone at 1-833-540-2118 or via e-mail at info@jsonic.ca to obtain necessary warranty claim forms and official claim process. ORIGINAL PROOF OF PURCHASE MUST ACCOMPANY ALL WARRANTY CLAIMS. The original residential purchaser will be notified by J Sonic Services as to whether the warranty claim is approved or denied.

Warranty Exclusions

The warranty will be void under the following circumstances:

• The Owner has sold or transferred the Product to someone else;

• Use of Product beyond normal and proper use, or in an application not recommended by J Sonic Services guidelines and local building codes;

• The Product has been installed, used, altered, or maintained in a manner contrary to the installation instructions provided;

• J Sonic Services cannot find any fault in the Product after conducting tests;

• The Product has been used for purposes other than it’s intended design, including misuse, overloading, installation in commercial settings, or failure to follow applicable assembly or installation instructions;

• The Product has been installed or used in non-residential settings. Here, “residential application” refers to properties such as single-family homes, detached duplexes, or residential apartments that are privately owned and used as a place of residence, not rented out or utilized for other purposes;

• The Product has been exposed to abnormal conditions such as extreme temperature, water, humidity, pressure, stress, or similar factors;

• The Product has been continuously used even after a defect or fault has been detected;

• The Product has experienced normal wear and tear, weathering, or damage caused by sunlight, severe weather, or atmospheric conditions, resulting in fading, chalking, soiling, or staining of the surface;

• The Product has suffered accidental or intentional damage, such as collisions, impacts from foreign objects, vandalism, or crashes;

• The Product has undergone setting or structural changes, shrinkage, distortion, or expansion of the property or structure it is installed on;

• The Product has been exposed to harmful or corrosive chemicals, including aggressive cleaning substances, pesticides, fumes, or vapors;

• The surface of the Product has deteriorated due to air pollution, coastal environments, airborne stains, mold, or mildew;

• The Product has warped or distorted due to excessive heat sources or unusual reflective heat sources;

• The Product has developed cracks or crazing due to extremely cold temperatures;

• The Product has been damaged by fire, lightning, flooding, hurricanes, tornadoes, windstorms, earthquakes, hail, acts of God, or any other unforeseen events.

Conditions of This Warranty

THIS WARRANTY IS NOT TRANSFERABLE. THE AMOUNT OF YOUR RESTITUTION WILL NOT INCLUDE LABOR TO REMOVE EXISTING COMPONENTS OR INSTALL THE REPLACEMENT COMPONENTS, SHIPPING CHARGES, SALES TAX OR ANY OTHER CHARGES, NOR IS J SONIUC SERVICES REQUIRED TO PROVIDE SUCH LABOR OR SERVICE. THE MANUFACTURER RETAINS THE RIGHT TO DEISGNATE A REPRESENTATIVE TO INSPECT THE FENCE AND REMOVE SAMPLES FOR ANALYSIS. REMOVING THE FENCE PRIOR TO INSPECTION VOIDS THE WARRANTY. THIS LIMITED WARRANTY IS IN LIEU OF ALL OTHER EXPRESS WARRANTIES. J SONIC SERVICES MAKES NO OTHER EXPRESS WARRANTIES AND DOES NOT AUTHORIZE ANY OTHER PERSON OR AGENT TO MAKE ANY OTHER EXPRESS WARRANTIES. J SONIC SERVICES NEITHER ASSUMES NOR AUTHORIZES ANY OTHER LIABILITY OR OBLIGATION IN WARRANTY, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THIS PRODUCT, IS LIMITED IN DURATION TO THE TWENTY (20) YEAR TERM OF THIS LIMITED WARRANTY. IN NO EVENT SHALL J SONIC SERVICES BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, OR INCIDENTAL DAMAGES ARISING OUT OF OR CONNECTED WITH THE PURCHASE OR USE OF THIS PRODUCT OR FOR ANY BREACH OF WARRANTY.
